Re:   2012 TEXAS TITLE INSURANCE AGENT EXPERIENCE REPORT SUBMISSION FOR THE CALENDAR YEAR ENDED DECEMBER 31, 2011



The Texas Department of Insurance (TDI) issues the attached mandatory call pursuant to §2703.153 of the Texas Insurance Code. Return the acknowledgement of receipt and listing of branch offices form included with this letter by fax or email no later than June 15, 2012. Copies of the forms and instructions are not included with this mailing, but you may download them from the TDI website at www.tdi.texas.gov/bulletins/index. Mailed submissions must be postmarked by July 26, 2012. TDI must receive emailed submissions no later than July 26, 2012.

Title Agent Call for Experience
All Texas title insurance agents must submit Texas title insurance experience according to the instructions in the attached manual. You must complete and submit the attached affidavit to attest to the accuracy of your report. You may not alter any of the exhibit forms, except to complete the required information. If it is necessary to explain any of the items reported, please do so in a separate written attachment or on the addendum page of the attached PDF form.

Please submit your experience using the interactive PDF form to reduce errors and to make your submission available to TDI electronically. To use the interactive form, you must have Adobe Reader version 8.0 or higher, which can be obtained for free at: http://get.adobe.com/reader/

Home Office Issue Policy (HOI) Reporting
Only report premiums for policies written in counties in which you are licensed on Forms A, B, and L. Show any income received for out-of-county transactions as fees received for closing on Form D. Do not show any expenses paid or premium splits paid on out-of-county transactions. Any expenses on Form F should only be for properties in counties for which you are licensed.

Agency Type
If your agency changed ownership during the past year, resulting in a change in agency type, report the agency type that represents the longest time span during 2011. If the time spans were equal, use the agency type from the earlier period.

Agent/Underwriter Premium Split
The agent/underwriter split of 85%:15% was in effect for the entirety of calendar year 2011, in accordance with Procedural Rule P-23, Division of Premiums between Title Insurance Agents and Title Insurance Companies.

1. an email to betty.flores@tdi.state.tx.us with attached pdf file or xml data file, and
2. a scanned or faxed copy of the signed and notarized affidavit.

If submitting by mail, your submission must include:
1. original completed copies of forms A-L, and
2. a signed and notarized affidavit.

Mailed submissions must be postmarked by July 26, 2012. TDI must receive hand-delivered or emailed submissions no later than July 26, 2012.

TDI will take appropriate action against agents that fail to meet this deadline or to provide complete and accurate data.
