Background information
Chapter 38, Subchapter J of the Texas Insurance Code establishes the Health Impact, Cost, and Coverage Analysis Program (HICCAP) to prepare analyses of legislative documents concerning potential new mandates on health benefit plan issuers and administrators. HICCAP is administered by The University of Texas Health Science Center at Houston. In accordance with Section 38.456, TDI will issue special data calls to collect estimated administrative expenses related to legislation under analysis by HICCAP. This section also includes provisions to ensure that data is collected, reviewed by HICCAP, and made available to policymakers in a timely manner.

Issuers of health plans, dental plans, and vision plans with active enrollment in Texas must submit contact information to TDI so that they can respond to special data call within the appropriate response time. In September of 2026, TDI issued a request under Texas Insurance Code 38.001 requiring these issuers to provide contact information. New entrants to the health, dental, and vision markets in Texas must also provide contact information.

Our contact information has changed. How do we update it?
Issuers can request that contacts can be added or removed by sending an email to HealthData@tdi.texas.gov requesting changes. Please use “HICCAP contact update” in the subject line and include the issuer name, NAIC number, and contact information to be changed. Alternatively, issuers may also complete a new contact information reporting form.
I represent more than one issuer. How do I report them?
Fill out a separate contact information reporting form for each NAIC-numbered entity.
How long does a health benefit plan issuer have to respond to a special data call on administrative expenses?
A health benefit plan issuer shall submit a response to the special data call in the form and manner prescribed by the commissioner before the later of: the 10th day after the date the commissioner issues the special data call; or a date determined by HICCAP. The special data call will have a due date listed at the top of the survey request.
Is there specific information the health benefit plan issuer must include with the response to the special data call?
In addition to answering the special data call, the health benefit plan issuer must include the calculation methodology used by the health benefit plan issuer to develop the responses to the data call.
What if an issuer receives a request to complete the special data call and has no active enrollment in the type of insurance subject to the request?
There will be an area on the special data call form for the issuer to attest that they have no active enrollment in the type of insurance subject to the special data call. They should complete that area and return the special data call form in the manner prescribed by the commissioner.
