Title underwriter statistical plan changes Q&A for 2025

Q: Where can I find a copy of the new Title Statistical Plan the Commissioner adopted effective January 1, 2025?

A: Title insurers and agents can the new statistical plan, the commissioner’s order adopting the rules, and detailed adoption exhibits on TDI’s page of Proposed and Adopted Rules for 2024.

Q: In the prior version of the Title Statistical Plan, the rate rule references for transaction codes 4001 through 4008 in Table 2 were wrong. The references for some of those transaction codes are to nonexistent provisions of Rule R-8. How does that affect my reporting under the new statistical plan?

A: This version of the Title Statistical Plan has corrected those errors and re-referenced transaction codes 4001-4004 and 4005-4008 to rate rules R-8.B.1. and R-8.B.2., respectively. Here’s an excerpt of the new stat plan showing the correction.

Q: What changes have been made to the title underwriter's stat plan, which became effective on January 1, 2025?

A: Rules adopted include new endorsements and changes to existing endorsements. Several of the rules require new or updated transaction codes in the underwriter stat plan. The transaction codes have been added to the appropriate tables in Appendix I, Tables 2 and 4. In some cases, descriptions were changed to accommodate splitting individual codes into distinct residential and non-residential codes. These code splits were made to accommodate endorsement premium differences between residential and non-residential properties. In those cases, the relevant descriptor has also been added.

In some cases, there are changes to a rate rule that don’t have any effect on the stat plan. For example, for Adoption Item 2023-1, sub-items 1 and 2 arrange for a premium increase. The relevant stat codes are 0211 and 0311, but nothing about the stat plan codes changes. The only change to be made is the premium associated with the code.

Q: Are there any other changes to the title underwriter's stat plan?

A: Yes. There have been various nonsubstantive changes such as font, formatting, descriptions, and corrections of clerical errors. For example, there was inconsistency in the rule-numbering convention in both the on-line rate rules and the rate rule references in the stat plan.

  • The “Change Number” column has been removed. This column was for internal use only, and it was accidentally included in the prior version.
  • The “Rate Rule Reference” column shows changes in the rule numbering convention.
    • For code 1305, you can see that the previous rule was identified as R-2c, and has been changed to include between periods before and after the “c”.
    • For code 1400, the previous rule was identified as R-5a, and has been changed to not only include the same periods before and after the letter “a”, but also capitalize the letter “A”.

While some inconsistencies still exist, we intend to move to the rule-numbering convention like “R-16.A.1.” Although the ultimate convention has not yet been fully deployed in the stat plan, the online rate rules have been fully changed. In the basic manual, you should no longer see rules with inconsistent conventions including lowercase letters, parentheses, or missing periods between the rule number and sub-rule letters.

Deletions

The prior version of Table 3 included code 9001, which has been deleted. The following excerpted marked-up image of the old stat plan is useful in showing this deletion.
