Re:   Filing deadline for 2024 annual network adequacy reports


This bulletin is to advise insurers to file their 2024 annual network adequacy reports no later than May 30, 2024. This bulletin applies to network adequacy reports that insurers must file with the Texas Department of Insurance (TDI) under 28 Texas Administrative Code Section 3.3709.

Several bills significantly affecting TDI's regulation of the managed care market were enacted by the 88th Legislature (2023), including HB 3359 (88R), which provides new network adequacy standards and requirements. Rules implementing these bills were adopted by TDI on April 5, 2024, and are available here: www.tdi.texas.gov/rules/2023/documents/20248601.pdf.

Under the rules, annual network adequacy reports will be due each April 1st. However, this year's deadline was extended to May 1, 2024, by TDI Bulletin #B-0002-24.

TDI is aware that some insurers have had difficulties meeting the filing deadline. To prevent disruption of the market, TDI is providing notice through this bulletin that TDI is further suspending enforcement of the 2024 filing deadline under 28 Texas Administrative Code Section 3.3709 until May 30, 2024.

TDI reminds insurers participating in the federal individual health insurance marketplace that TDI is required to notify federal officials by August 19th which networks are approved to operate in Texas effective January 1, 2025. Further, a waiver of any network adequacy requirements may not be granted without having a public hearing on whether there is good cause to grant the waiver. Thus, insurers expecting to seek waivers should file with TDI as early as possible.
