To:   All insurers licensed to write property and casualty insurance in Texas, including surplus lines and farm mutual insurers

Re:   Call for data collection for the February 2021 Texas winter weather event


Catastrophe event
Reporting is required for the February 2021 Texas winter weather event that took place starting on February 11, 2021, through February 19, 2021, throughout Texas. For property lines of insurance, companies should include any claims or losses with occurrence dates from February 11 through February 19 that resulted from any of the following causes of loss: freezing (including any resulting water damage), ice, snow, wind, or power outage. For automobile lines of insurance, report all claims with accident dates from February 11 through February 19. Report claims resulting from the winter weather event regardless of when the damage was discovered.

Reporting requirements
The Texas Department of Insurance (TDI) requires reporting of catastrophe-related data by insurers under Insurance Code Chapter 38, Subchapter E, and Insurance Code Section 38.001. TDI is seeking only property insurance information for the 2021 winter weather event.

Texas Catastrophe Event Statistical Plan for Personal and Commercial Risks (statistical plan)

Companies are required to report data for all lines listed under the statistical plan. All listed companies showing an "X" in either the Property, Auto, or All Other columns on TDI's list of companies must report data to ISO. Companies not shown in either list are not required to report data. There are separate lists for admitted and surplus lines companies.

Companies must file their reports under the statistical plan. Companies should review the statistical plan, specifically Section 4, to determine which lines it must report. In addition to reviewing the statistical plan, please refer to 28 Texas Administrative Code Section 5.9502 for more information about reporting under the statistical plan.

Deadline
The first report for data as of February 28, 2021, is due March 31, 2021. Subsequent reports are due monthly, at the end of each month.

Submission information
Companies must send all reports to TDI's statistical agent, Insurance Services Office, Inc. (ISO). ISO needs reporting insurers that have not yet registered with ISO to complete the attached form to set up the appropriate credentials for statistical reporting. Please return the form to ISO at TXCatStatAgent@verisk.com. Companies that registered with ISO in response to Bulletin B-0040-20 do not need to register again. Any questions about registering with ISO should be sent to TXCatStatAgent@verisk.com. Once your registration is processed, ISO will provide you with your credentials and relevant reporting instructions.

Insurers should contact ISO even if the company does not have any claims to report for the winter weather event. These companies will still be required to respond to TDI's bulletin as provided in the statistical plan.

Under Insurance Code Section 38.001(d), a response made under this section––whether to a statistical agent or to TDI––that is otherwise privileged or confidential by law remains privileged or confidential until introduced into evidence at an administrative hearing or in a court. Insurers should identify which documents are privileged or confidential in their responses.
