The attached mandatory Quarterly Consumer Information Data Call is being issued pursuant to §38.001 of the Texas Insurance Code (TIC) and is the basis for a quarterly Consumer Information Report that the Department must submit to the Texas Legislature and the public. The quarterly Consumer Information Report is required by the General Appropriations Act, Senate Bill 1, 81 st Legislature, Regular Session, paragraph 12, page VIII-23, effective September 1, 2009.
The Quarterly Consumer Information Data Call is due no later than 40 days after the last day of each calendar quarter. The first reporting period will cover third quarter 2010 experience (July 1, 2010 - September 30, 2010), and this data call must be completed and returned in accordance with the instructions no later than November 10, 2010.
Insurance carriers and HMOs should download the data entry form, affidavit, and instructions from the Department's website at www.tdi.state.tx.us/bulletins/index.html. Once you locate Bulletin # B-0039-10 on the web page, you may click directly on the bulletin number to access these electronic files.

All underlying data, individual source documents and other information utilized in the development of your response must be maintained in your records for a minimum of three years after the due date of the data call. This information must be provided to the Texas Department of Insurance upon request.
Failure to comply with the requirements of this data call within the time limits specified may constitute a violation or violations of the TIC and may subject the insurer to the penalties provided by law.
