This bulletin announces the 2009 call for information. The acknowledgement of receipt and listing of branch offices form included with this letter should be faxed, e-mailed, or postmarked no later than May 4, 2009. Please read the directions below on reporting home office issue policies. You will be required to attest to the accuracy of this reporting when you submit your report.
Title Agent Call for Experience
Pursuant to the authority of §2703.153 of the Texas Insurance Code (TIC), the Texas Department of Insurance requests that all Texas title insurance agents submit information relating to title insurance experience.
Please submit your title insurance experience according to the instructions in the manual. No alterations of the exhibits will be permitted. Should it become necessary to explain any of the items reported, please do so in a separate written attachment.
Please note changes for 2009
This year we are introducing a new method of completing and submitting your agent statistical report using an electronic fill-in PDF form. This method offers you many advantages that were not available before. For example, the interactive PDF form allows you greater flexibility in accessing the form using either the free Adobe Reader software or by downloading the form on Acrobat.com. In addition, the interactive PDF form allows you to submit the data file via email, eliminating the need to mail a diskette or CD with your submission packet. Although you are not required to use the interactive PDF form for your submission; please know that the department is looking for alternative methods for submission and will eventually replace the TACS program entirely. Consequently, you are highly encouraged to use the new interactive PDF form for your 2009 submission. Please review the Interactive PDF Form Instructions for further information.
Home Office Issue Policy
Reporting
Only report premiums for policies written in counties in which you are licensed. Any income received for out-of-county transactions are to be shown as fees received for closing on Form D. Do not show any expenses paid or premium splits paid on out-of-county transactions. If you include any expenses on Form F, those should only be for properties in counties for which you are licensed.
Agency Type
If your agency changed ownership during the past year which resulted in a change in agency type, report the agency type that represents the longest time span during 2008. If the time spans were equal, use the agency type from the earlier period.
Agent/Underwriter Premium Split
The agent/underwriter split of 85%:15% was in effect for the entirety of calendar year 2008.

A completed HARD COPY submission packet should include:
- original completed copies of forms A-L
- a signed, notarized affidavit
A completed PDF FORM submission packet should include: (**if you are submitting using the PDF form, the email date will serve as your date of submission)
- a printed hard copy of the entire report
- a signed, notarized affidavit
- an email with an attached .xml file sent to: datacall@TDI.state.tx.us
A completed TACS PROGRAM submission packet should include:
- a diskette or CD containing a file exported from the TACS program,
- a printed hard copy of the entire report from the TACS program
- a signed, notarized affidavit

Agents submitting manually or by TACS must have their submission postmarked on or before June 10, 2009. (please include a printed copy of your report along with the diskette)
Agents submitting using the electronic PDF form must have their email with attached .xml file received on or before June 10, 2009.
Failure to meet the applicable deadline(s) and/or to provide complete and accurate data may result in the imposition of sanctions by the Department.
