Re:   Financial Responsibility Verification Program


Commissioner's Bulletin No. B-0044-06 was issued on December 15, 2006, and highlighted the roles, responsibilities, and resources available under the Texas Financial Responsibility Verification Program (FRVP).

The FRVP Reporting Guide and User Manual (user manual), which provides technical guidance to insurers on how to comply with the requirements and procedures specified in the FRVP rule (28 TAC §§5.601 - 5.611), has been revised. Updates are outlined in Appendix 1 of the Reporting Guide and User Manual, Version 1.1. The revised version of the user manual may be obtained from the Data Services Division of the Texas Department of Insurance (Department), Mail Code 105-5D, P.O. Box 149104, Austin, TX 78714, or the Department's website at www.tdi.state.tx.us/company/frvp.html. A copy may also be requested via email at TexasFRVP@tdi.state.tx.us.

Insurance companies and managing general agents (MGAs) that have not already done so are encouraged to submit a Company Profile Form, as provided in the user manual, to the program vendor as soon as possible.

Authorized insurers and MGAs that are not participating in the FRVP for one or more of the following reasons are encouraged to submit an email to the FRVP Coordinator at TexasFRVP@tdi.state.tx.us. The email should include the company name, NAIC number, and the reason the company is not participating. Insurers and MGAs are required to comply with the FRVP as specified in 28 TAC §§5.601 - 5.611. In accordance with 28 TAC §5.601, an insurer or MGA is not required to comply if it is:

1. Authorized but not writing personal automobile insurance in Texas.

2. Authorized but not writing commercial automobile insurance in Texas.

3. Authorized and writing commercial automobile insurance but opting not to report at this time.

 

The Department will establish an email distribution list for dissemination of information and news related to the FRVP. Anyone who would like to be included on this list may send an email request to TexasFRVP@tdi.state.tx.us.

 

The Department and the program vendor, HDI Solutions, Inc., will host twice-monthly conference calls open to all insurers and MGAs. These conference calls will provide an open forum for questions and answers related to the FRVP with Department staff and program vendor technical staff. Conference calls will be held on the second and fourth Wednesdays of the month at 10:00AM CST, beginning March 14, 2007. Please send an email request to TexasFRVP@tdi.state.tx.us for conference call information.

 

The Department, implementing agencies, program vendor, and volunteer insurers and MGAs are in the process of establishing a task force for the development of a web services alternate test program. Participation on this task force is in addition to the database reporting requirements of the FRVP, as provided in 28 TAC §5.611(d). Any insurer or MGA interested in participating on this task force should send an email to TexasFRVP@tdi.state.tx.us. Additional information can be found on the Department's website at www.tdi.state.tx.us/company/frvp.html, including an Invitation to Participate with background information on the task force and web services alternate test program. Meeting notices related to the web services alternate test project will be posted on the Department's website and distributed via email to all parties who express interest.
