Re:   LEGISLATION ENACTED - 80TH LEGISLATIVE SESSION


This bulletin provides information and brief summaries of selected bills enacted during the 80th Regular Legislative Session.

Attachment A provides summaries of the bills that will require insurer action relating to certain types of policies issued, renewed, sold, or serviced in Texas. The summaries highlight portions of the bills pertinent to the business of property and casualty insurance and workers' compensation insurance, including the effective and implementation dates.

Attachment B provides a list of bills that may require insurer action or awareness relating to certain types of policies issued, renewed, sold or serviced in Texas. The bills contained in Attachment B have not been summarized because they have less impact on property and casualty or workers' compensation insurance.

The Department is only providing information with regard to the provisions of the bills that apply to property and casualty, including workers' compensation insurance. Please refer to the actual bills for the complete content of the legislation. You may access electronic copies of the bills directly from the attachments if you are viewing them on a Web enabled computer. Each bill number will link you directly to the enrolled bill text. Alternatively, you may access the bills, as well as other legislative information, at the Texas Legislature Online website at www.capitol.state.tx.us. You may obtain paper copies of the bills for a charge by contacting, respectively, House Bill Distribution at 512-463-1144 and Senate Bill Distribution at 512-463-0252.

While the Department has attempted to include all relevant recently enacted legislation, the attachments may not list all legislation that may affect insurers. Moreover, the attachments may not list every action needed to comply with and implement new legislation. While the Department encourages use of the bulletin to aid in compliance efforts, insurers are responsible for ensuring compliance with all enacted legislation affecting the business they conduct.

To complement your review of this listing of the relevant bills, the Department has posted legislative implementation plans on its website at www.tdi.state.tx.us/reports/report10.html.

The Department requests that you share this information with your staff, agents, and other affected parties so that you may completely and timely implement any changes necessary to comply with new and amended statutes. Insurers should review each bill listed in the attachments and make the appropriate filings to amend rates, rules or policy forms. Insurers should also monitor the Department's website for rules that may be proposed to implement the legislation.
