Re:   Commissioner's Order No. 03-0110, adoption of new residential property policy forms under Insurance Code Article 5.35(b), and approval of new residential property policy forms under Insurance Code Article 5.35(c).


Effective March 15, 2003, the Commissioner of Insurance by Commissioner's Order No. 03-0110 adopted two new dwelling policy forms which include form nos. DP 00 03TX (Dwelling Property 3TX Special Form) and DP 00 02TX (Dwelling Property 2TX Broad Form); six new renters insurance forms which include form nos. RP-1TX (General Provisions), RP-2TX (Broad Personal Property), RP-3TX (Broad Personal Property with Replacement Cost), RP-4TX (Special Personal Property), RP-5TX (Special Personal Property with Replacement Cost), and RP-6TX (Personal Liability) filed by United Services Automobile Association and USAA Texas Lloyd's Company (collectively referred to as USAA) and further has adopted twenty-two new dwelling endorsements and nineteen new renters endorsements that may be attached to the new dwelling and renters policy forms for use in the State of Texas. These policy forms and endorsements were approved pursuant to Insurance Code Article 5.35(b).

Other Insurers Who Elect to Use the USAA Residential Property Policy Forms and Endorsements. Pursuant to Article 5.35, an insurer that wishes to use the adopted policy forms and endorsements must make a filing for approval with the Texas Department of Insurance and agree to abide by the conditions and requirements imposed by the applicable adoption order relating to rating information, water damage coverage, foundation coverage, and mold coverage.

Copies of the USAA policy forms and endorsements may be requested from the Office of Chief Clerk, P.O. Box 149104, Mail Code 113-3A, Austin, Texas 78714-9104.

Effective February 26, 2003 the Texas Department of Insurance, under Filing Link No. 59350, TDI #9212418907 approved, for American Association of Insurance Services (AAIS), policy forms and endorsements contained in the filing, which constitute the new AAIS Homeowners Program. This program provides coverage options for homeowners, tenants and condominium unit-owners and is comprised of seven new policy forms which include Form 1 (Basic Form), Form 2 (Broad Form), Form 3 (Special Form), Form 4 (Contents Broad Form), Form 5 (Special Building and Contents Form), Form 6 (Unit-Owners Form), and Form 8 (Limited Form) as well as sixty-eight new endorsements and one sworn statement in proof of loss form. These policy forms and endorsements were approved pursuant to Insurance Code Article 5.35(c).

Pursuant to Article 5.35, an insurer that wishes to use the approved policy forms and endorsements must make a filing for approval with the Texas Department of Insurance and agree to abide by the conditions and requirements imposed by the approval letter relating to rating information, water damage coverage, foundation coverage, and mold coverage.
