Enclosed herewith you will find Commissioner's Bulletin No. B-0031-97 (W. C. Circular Letter No. 686-A and Retrospective Rating Article No. 179-A). This bulletin is issued due to the Texas Workers' Compensation Insurance Facility correcting the voluntary premium writings reported to the Texas Department of Insurance (TDI) for 1992, 1993 and 1994. This correction to the voluntary premium writings results in a recalculation of the Residual Market Factor (RMF) for each of those years, as reflected in the attached bulletin. The Texas Department of Insurance has reviewed and confirmed the corrected voluntary premium writings and believes that no further revisions are in order. There is no change to the 1991 voluntary premium writings or to the 1991 RMF. Each insurer shall calculate and return the appropriate Residual Market Premium (RMP) to each retrospectively rated policyholder affected by these rules in accordance with the RMF's set forth in Commissioner's Bulletin No. B-0031-97 which is enclosed.
