Leased buildings on state property

Your agency should inspect buildings on state property that are leased to private entities. If the local municipality inspects the building, verify that the inspection is consistent with agency and State Fire Marshal’s Office (SFMO) inspection process and complies with nationally recognized inspection standards. SFMO will also conduct its required inspection during its inspection cycle.

Lease agreements

SFMO encourages lease agreements with businesses to include language that says:

  • Management and ownership acknowledge the State Fire Marshal’s Office (SFMO) as the authority having jurisdiction for the business when the agreement is signed.
  • Management and ownership agree to abide by adopted standards of SFMO.
  • The leasing state agency can terminate the lease if the building isn’t code compliant.
