  • NCCI Item 02-TX-2023 - Revisions to NCCI's Basic Manual for Texas for Classifications and Table of Classifications by Hazard Group. The filing revises the treatment for certain classifications in NCCI's Basic Manual for Texas. The changes will align Texas classifications with multistate classifications and phraseology. Order 2024-8571 issued 3/13/2024.

  • NCCI Item R-1422 - Revisions to the Retrospective Rating Plan Manual Rule Related to the Tax Multiplier. The filing updates information related to state and federal tax multipliers. Comments due 10/9/2023. 
  • NCCI Item B-1449 - Revisions to Basic Manual Rules Related to Service Charges and Automatic Gratuities. NCCI proposes these changes to clarify that service charges and automatic gratuities are included in payroll. Comments due 8/30/2023.
  • NCCI Item B-1448 - Revisions to Basic Manual Rules Related to Payroll Inclusions and Payroll Exclusions. TDI seeks input on a commenter’s recommendation to change the maximum daily expense allowance in the payroll exclusion rule for nonverified expenses incurred on overnight business.   • NCCI Item E-1410 - Revisions to NCCI Manual Rules Related to the Inclusion of COVID-19 (Coronavirus) Claims in Experience Rating and Merit Rating.  The filing establishes an end date for special treatment of COVID-19 claims.  Order 2023-7932 issued 5/4/2023 and corrected Order 2023-8006 issued 6/6/2023.

Workers' Compensation Manuals

Current Manuals: TDI has adopted the following National Council of Compensation Insurance (NCCI) manuals, with Texas exceptions. NCCI's manuals are available by subscription at www.ncci.com.

  • Basic Manual for Workers Compensation and Employers Liability Insurance (Basic Manual), optionally for policies with effective dates on or after June 1, 2014; and required for policies with effective dates on or after October 1, 2014 (see Commissioner's Order No. 3142, March 21, 2014).

  • Forms Manual of Workers Compensation and Employers Liability Insurance (Forms Manual), optionally for policies with effective dates on or after June 1, 2014; and required for policies with effective dates on or after October 1, 2014 (see Commissioner's Order No. 3142, March 21, 2014).

  • Statistical Plan for Workers Compensation and Employers Liability Insurance (Statistical Plan), for reporting statistical data for Texas worker's compensation policies with effective dates on or after January 1, 2015 (see Commissioner's Order No. 3455, July 29, 2014).

  • Experience Rating Plan Manual for Workers Compensation and Employers Liability Insurance (Experience Rating Plan Manual), for calculating experience rating modifications with effective dates on or after July 1, 2015 (see Commissioner's Order No. 3708, December 5, 2014).

  • Retrospective Rating Plan Manual for Workers Compensation and Employers Liability Insurance (Retrospective Rating Plan Manual), available for use in Texas as of June 1, 2011. For new and renewal workers' compensation policies written on a retrospectively rated basis with effective dates on and after January 1, 2017, insurers must either make a reference filing with TDI to use the NCCI Retrospective Rating Plan Manual, or file their own retrospective rating plans with TDI. (See Commissioner's Order No. 4215, December 7, 2015).

  • For policies effective prior to 10/01/2014 ONLY - Texas Basic Manual of Rules, Classifications and Experience Rating Plan for Workers' Compensation and Employers' Liability Insurance. The rules, classifications, endorsements and forms contained in the Texas Basic Manual (PDF) expired at 12:01 a.m., October 1, 2014. View specific section:
  • The Experience Rating Plan contained in the Texas Basic Manual remains in effect for calculating and revising experience rating modifications with effective dates before July 1, 2015.
