Telemedicine and telehealth timeline Division of Workers' Compensation (DWC) Centers for Medicare and Medicaid Services (CMS) 9/1/18 - DWC adopts 28 TAC §133.30, Telemedicine and Telehealth Services. The health care provider may bill and be reimbursed for telemedicine and telehealth services. The services must be within their scope of practice and regardless of where the injured employee is located. 3/17/20 - CMS expands telehealth service areas to anywhere a patient is located. 3/30/20 - CMS adds 80 codes to the list of telemedicine and telehealth services. 4/13/20 - DWC adopts an emergency rule in 28 TAC §167.1 allowing health care providers to bill and be reimbursed for physical medicine services on the CMS list of telemedicine and telehealth services, including physical therapists (PTs), occupational therapists (OTs), and speech language pathologists (SLPs). 4/30/20 - CMS adds PTs, OTs, and SLPs as eligible providers. 10/8/20 - DWC emergency rule 28 TAC §167.1 expires. 28 TAC §133.30, Telemedicine and Telehealth Services remains in effect. CMS continues to allow PTs, OTs, and SLPs to provide telehealth services on the CMS list of telemedicine and telehealth services.
