The Texas Department of Insurance reminds health maintenance organizations and health insurers that they are required to give the Commissioner at least 30 days written notice before entering into transactions with affiliates, including affiliated providers. Agreements with affiliates are subject to Insurance Code Sections 823.101 and 823.103 (specifically 823.103(a)(4)) and 28 Texas Administrative Code Sections 7.204 and 7.212. Failure to comply with these requirements may result in administrative action and sanctions.
