April 30, 2020

To:   All insurers licensed to issue health benefit plans, including health maintenance organizations and preferred provider plans

Re:   COVID-19: Delaying 2019 mandated health benefits data reporting

Insurance Code Section 38.252 instructs the Texas Department of Insurance (TDI) to require health benefit plan issuers to collect and report cost and utilization data for mandated health benefits at least once every two years. The most recent reporting occurred in 2019, when TDI collected the data for 2018. In light of the COVID-19 pandemic, TDI will delay the collection of 2019 data.

TDI will collect the 2019 mandated health benefits data in 2021. At that time, health benefit plan issuers will report 2019 and 2020 data.
