Texas Insurance Code §521.052 requires the Texas Department of Insurance to provide consumers with complaint ratios. The ratios must represent the number of “justified, verified as accurate, and documented as valid” complaints received against a company, “expressed as a percentage of the total number of insurance policies written by the insurer and in force on December 31 of the preceding year.” To satisfy this mandate for complaints received in 2015, TDI requires companies to report the number of policies in force as of December 31, 2015.
Please read, then complete and file with TDI, the attached form to report the required information. The filing is due no later than March 1, 2016. TDI requests this information under Insurance Code §38.001 and §521.052.
This filing is not for the combined reporting of a group of affiliated companies. Each company licensed in Texas as of December 31, 2015, must submit a separate filing. TDI is sending a separate notice to each licensed company and to each surplus lines carrier eligible to do business in Texas.
NOTE: The mechanism TDI uses to collect this data is the same as used last year, that is, an Adobe fillable PDF form. While the form is essentially the same, we have added two fields back to the form to capture the fax area code and fax number. Please see the email announcement for more filing instructions. After submitting your filing via email, please do not submit additional copies unless requested by TDI to do so.
