COMMISSIONER'S BULLETIN # B-0030-13

December 03, 2013

To: ALL INSURANCE COMPANIES, CORPORATIONS, EXCHANGES, MUTUALS, RECIPROCALS, ASSOCIATIONS, LLOYDS, SURPLUS LINES, OR OTHER INSURERS WRITING PROPERTY AND CASUALTY INSURANCE IN THE STATE OF TEXAS

Re: MANDATORY DATA CALL FOR INFORMATION REGARDING THE AMOUNT OF CREDIT VOLUNTARY RESIDENTIAL PROPERTY INSURERS PROVIDE FOR EXCLUDING WINDSTORM AND HAIL COVERAGE IN THE CATASTROPHE AREA

The Texas Department of Insurance is conducting a mandatory data call to assist the Texas Windstorm Insurance Association in setting rates for structures eligible for coverage through TWIA under Senate Bill 1702, 83rd Legislature, Regular Session (2013). SB 1702 allows certain structures that were canceled or nonrenewed by their voluntary market insurer to obtain coverage through TWIA. To provide coverage for these structures, TWIA must charge a premium based on the rate charged in the voluntary market for the portion of the canceled or nonrenewed policy that provided windstorm and hail insurance coverage, plus an annual premium surcharge of 10 percent.

This data call is designed to gather information that will enable TWIA to set a premium for structures eligible for coverage under SB 1702, which is based on the rate charged in the voluntary market for windstorm and hail insurance coverage in the catastrophe area.

Under Insurance Code ยง2210.259, TDI directs all the above-referenced insurers to provide the data requested in the Residential Property Windstorm Exclusion Credits Data Call Reporting Instructions, Methodology Description Form, Transmittal Form, and Data Reporting Form, accessible online at the following links:
