Re:   Commissioner's Order No. 04-1082 repealing Title 28 Texas Administrative Code §5.9101, Commercial Multi-Peril Policies, and Commissioner's Order No. 04-1083 adopting new Title 28 Texas Administrative Code §5.5005, Rates for Commercial Multi-Peril Policies.


The repeal of §5.9101 and adoption of §5.5005 were necessary to implement amendments to the Texas Insurance Code as enacted by Senate Bill 14, 78th Legislature, Regular Session.

New §5.5005 provides that all companies offering commercial multi-peril policies, including Lloyd's plans, reciprocals, and interinsurance exchanges are subject to the rate filing requirements of Article 5.13-2, Insurance Code, except as provided by subsection (d) of the rule. The reduced filing requirements contained in subsection (d) of the rule, require Lloyd's plans, reciprocals, and interinsurance exchanges to file a schedule of the amounts to be charged and the amount of any rate changes for commercial multi-peril policies that contain a combination of certain lines of insurance.
